4) Communications, Phone Calls, and SMS/Text Messaging
By submitting a form or providing your phone number through the Site, you consent to receive communications from TORQ, including phone calls and SMS/text messages, to provide updates on your order, respond to inquiries, and send promotional or marketing content. Message frequency depends on your activity. You may opt out at any time by texting “STOP” and you may reply “HELP” for more information. Message and data rates may apply. Consent to receive messages is not a condition of purchase.
You are responsible for providing accurate contact information. If your phone number changes, you agree to notify us to help prevent messages being sent to the wrong person.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORQ AND ITS OWNERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR COMMUNICATIONS THROUGH THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORQ’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID TO TORQ THROUGH THE SITE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless TORQ and its owners, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site.
